Sure thing, we all would like some clarifications here. As 1st Oneplus user, it seems I got just in the middle of a storm.
I was just trying to clarify the GDPR stuff as it seemed you, like us all, we are in doubt about what is delaying so much the EU updates.
BTW, I got my C.38 update via official OxygenOS link. The link is available in the XDA developers site, in a topic like "OOS 12 update tracker", but points to OxygenOS site. From there I got the full OTA and flashed from OOS 11.2.10.10 local update feature. Since then, running smoothly regarding battery, not heating issues and so on. A few minor bugs, but not all the time. Some reboots from time to time do the trick. :D

That's hard to say. Some have no issues with the EU C38 build while others do and some have no issues with the global C39/C40 build while, again, some others do. So you won't know how they are until you've tried them i'm afraid

That's not 100% true, they have little to no problem giving ColorOS to OnePlus phones, it's the merging of OxygenOS and ColorOS codebase that's causing the problems. Going by the reviews I saw of pure ColorOS 12 on China OnePlus phones that seems to be performing very well.

You have the EU model so the C38 is the EU build you would have gotten if they had officially released it.

    Hey everyone,

We noticed quite a few users from Europe are asking when a build for them will be available. Rest assured the Software team is working hard to release it as soon as possible and will be released gradually in January 2022.

To provide you a bit of context as to why the European builds are being released separately, this is due to a stricter Technical Approval process in the EU. The build requires certification from multiple stakeholders (different carriers in different countries) which makes the process take longer for this region.

    Thank you for your understanding.
